1. Application

These Terms of Use ("Terms") apply to all relations between the Moss Kogei Kyoto Executive Committee ("we," "us," "the Committee") and users ("you") in connection with our website (https://mosskogei.com, "the Site") and the "Moss Kogei Kyoto" event ("the Event"). By using the Site or purchasing any ticket, product, or service, you are deemed to have agreed to these Terms.

2. Definitions

  • "Services" means the tickets, products, and services offered through the Site (admission, workshops, talks, tea ceremonies, dining programs, merchandise, etc.).
  • "You" means any individual or entity that uses the Site or purchases or uses the Services.

3. Agreement to these Terms

Please use the Services only after agreeing to these Terms. Minors must obtain the consent of a parent or legal guardian.

4. Purchases

  • You may reserve or purchase tickets, products, and services following the steps shown on the Site.
  • A sales contract is formed when we accept your order and notify you (e.g., by confirmation email).
  • Items and services may have capacity or stock limits; once reached, we cannot accept further purchases.
  • Tickets are valid only for the specified date, time, and content. Resale, transfer, duplication, and other misuse are prohibited.

5. Prices and payment

  • Prices are shown on each product page. Final prices shown to consumers are displayed as a tax-inclusive total.
  • Payment methods, timing, and other sales conditions are as set out on the Site and in the "Specified Commercial Transactions Act Disclosure."
  • Payments are processed through our designated payment provider (e.g., Shopify Payments).

6. Cancellation and refunds

Because the Event is a date-, capacity-, and content-limited occasion, the following applies (individual product pages may set specific terms):

  • Cancellations, changes, and refunds requested for your own convenience cannot, as a rule, be accepted.
  • Physical goods and programs involving orders/preparation by makers are non-returnable and non-refundable after purchase.
  • This does not apply where a refund is required by law, or where we cannot provide the service due to reasons attributable to us.
  • Cooling-off does not apply to mail-order (online) sales; returns/cancellations are governed by this section and the Specified Commercial Transactions Act Disclosure.

7. Changes or cancellation of the Event

  • We may change performers, program, venue, or schedule for unavoidable reasons. Minor changes are not subject to refund.
  • If all or part of the Event is cancelled due to force majeure (natural disaster, epidemic, government order, etc.), the treatment (including whether and how much is refunded) will be determined separately by us and announced on the Site.

8. Admission and conduct at the venue

You must follow the rules of the Committee and the venue (Shozan Resort Kyoto, etc.) and the directions of staff. The following are prohibited:

  • Causing nuisance or harm to other guests, performers, makers, staff, or third parties
  • Touching or damaging exhibited works, photography/recording outside designated areas, or filming for commercial purposes
  • Bringing in dangerous or prohibited items, or otherwise disrupting order at the venue

If you breach this section, we may refuse or require you to leave, without refund.

9. Prohibited acts

You must not violate laws or these Terms, infringe the rights of us or third parties, interfere with our operations, or engage in unauthorized access or similar acts.

10. Intellectual property

All intellectual property rights in the trademarks, logos, text, photographs, video, designs, and other content relating to the Site and the Event belong to us or the rightful owners. You may not reproduce, republish, modify, distribute, or otherwise use them without our prior written consent.

11. Disclaimer and limitation of liability

  • We do not warrant the fitness for a particular purpose, accuracy, or completeness of the Services.
  • We are not liable for loss you incur at the venue due to reasons attributable to you, or for loss due to reasons not attributable to us.
  • Except in cases of our willful misconduct or gross negligence, our liability is limited to the amount you paid us. This limitation does not apply to the extent it conflicts with the Consumer Contract Act or other mandatory law.

12. Exclusion of anti-social forces

You represent and warrant that you are not, and have no relationship with, organized crime groups or other anti-social forces. If this proves untrue, we may suspend the Services and terminate the contract without notice.

13. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute between us and you relating to the Services or these Terms shall be subject to the exclusive jurisdiction of the Kyoto District Court as the court of first instance.

14. Changes to these Terms

We may amend these Terms as needed. Amended Terms take effect when posted on the Site; material changes will be announced by appropriate means.
